A claimant filed a case against a defendant before the court. He requested the court to order the defendant to proceed with the proceedings to liquidate f a disputed company.

The defendant said that he had filed a case against the other partners. He said that he handed the report of the liquidation to the partners.

The court said that the case documents revealed that the claimant had made an urgent request to increase his expenses. The court said that the claimant delayed the process of liquidation for nine years. The court said that the element of urgency had not been met in the claimant's case.

The court dismissed the case.

The Court of Appeal – Jeddah upheld the ruling based on the same grounds.
