Background
A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay him 280000 Riyals. He said that he had paid this amount to the defendant in order to invest but the latter had failed to commit to his obligations.
The defendant admitted the transaction but he refused to provide the court with the documents that showed the investments he had made.
Decision
The court said that the case documents revealed that the claimant provided the court with all documents that prove his claims. The court said that the defendant failed to provide the court with any evidence and therefore the court should dismiss his claims according to Article 67 of Saudi Arabia Cabinet Decision No. 11/1435.
The court ruled that the defendant should pay the claimant the mentioned amount.
The Court of Appeal – Mecca upheld the ruling based on the same grounds.
