SCA 1402/2019

This case involved an outstanding out due under a contract. Although it was claimed a representative had signed the contract without authorisation. The defendants had paid part of the debt so should pay the full amount.

Background

A claimant filed a case against defendants before the court. They said that a ruling issued against them stipulating that they should pay 600000 Riyals. They said that they had agreed with the defendants to pay the amount. The claimant requested the court to order the defendants to pay the amount.

The defendants said that they did not sign the mentioned agreement and that their representative had signed it though he did not have the authorization to do so.

Decision

The court said that the case documents revealed that the defendants had already paid part of the debt. The court said that the defendant claimed that their representative signed the agreement and he did not have the authorization to do so though they had already paid part of the debt.

The court ruled that the defendants should pay the mentioned amount.

The court of appeal has upheld the ruling based on the same grounds.
