SCA 1392/2019

This case involved the validity of an urgent request for cars being bought on hire purchase not to be seized because two payments were missed.

Background

A claimant filed a case against a company before the court. He said that he had agreed to rent seven cars according to a Lease-to-own agreement with the company for 532700 Riyals. He said that he committed to his obligations and used to pay the rent. He said that he had failed, however, to pay the rent for two months. He said that the company took the cars from him and submitted payment orders to the Ministry of Commerce. He requested the court to suspend the execution of the payment orders.

Decision

The court said that the relevant laws gave the claimant the right to make a plea to the Ministry of Commerce. He said that the urgent request made by the claimant did not meet the relevant legal conditions.

The court dismissed the case.

The claimant appealed the ruling before the court of appeal.

The court dismissed the appeal and upheld the appealed ruling.
