SCA 1383/2019

This case involved the obligation of a company to fix faults in a car. The company had fixed faults documented in a contract and the claimant had not provided evidence of other faults.

Background

A claimant filed a case against a company before the court. He requested the court to order the company to pay him 90700 Riyals. He said that he had brought his car to the company so they could fix it but the company had failed to commit to their obligations.

The company claimed that they had met their obligations and that they did not bear the responsibility for the other faults which had appeared in the car.

Decision

The court said that the case documents revealed that the company had committed to their obligations and had fixed a problem mentioned in the contract between the two parties. The court said that the claimant had failed to prove his claim.

The court dismissed the case.

The Court of Appeal – Jeddah upheld the ruling based on same grounds.
