SCA 1356/2019

This case involved non-payment for concrete. It was claimed the person who had signed the bills lacked authority. The signature and stamp on the bills proved they belonged to the company.

Background

A company filed a case against a defendant before the court. The company requested the court to order the defendant to pay 1034987 Riyals. The company said that they had supplied the defendant with concrete but the defendant had failed to pay the value of the contract.

The defendant said that he had paid the value of the contract to the company. He said that the bills provided by the company had been signed by a person who did not have authorization to do so.

Decision

The court said that the case documents revealed that the signature and the stamp on the bills provided by the company belonged to the defendant. The court said that the bills therefore should be considered as formal evidence according to Article 139 of tSaudi Arabia Cabinet Decision No. 11/1435.

The court ruled that the defendant should pay the company the amount.

The court of appeal has upheld the ruling based on the same grounds.
