SCA 1332/2019
This case involved investment in some shops where there was a failure to pay agreed profits. The defendant claimed this was because the shops had made losses. A key point was the evidence of the agreement and failure of the defendant to provide evidence of the losses.
Background
A claimant filed a case against a defendant before the court. He said that he had paid the defendant 1000000 Riyals in order to invest in some shops. He said that the defendant had failed to commit to his obligations. He requested the court to order the defendant to pay him the mentioned amount.
The defendant confirmed that he had received the amount but he claimed that the business had made losses.
Decision
The court said that the case documents revealed that the claimant had provided the court with the documents that proved his claim. The court said that the defendant had failed to prove his claim on the business losses.
The court ruled that the defendant should pay the claimant the amount in addition to the lawyer's expenses.
The Court of Appeal – Jeddah upheld the ruling based on same grounds.
