SCA 1327/2019
This case involved non-payment for contracting work. A key point was a final settlement document and the oath taken by the defendant.
Background
A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay him 5760298 Riyals. He said that he had finished contracting work for the defendant and that latter failed to commit to his obligations.
The defendant claimed that the two parties had reached a final settlement which stipulated that the claimant deserved 4418372 Riyals.
Decision
The court said that the final settlement document revealed that the claimant had received the contract amount. The court said that the defendant took the oath in order to prove their claim.
The court dismissed the case.
The Court of Appeal – Jeddah upheld the ruling based on the same grounds.
