Background

A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay him 3492100 Riyals. He said that the defendant had installed health and safety systems for his company. He said that he found that the systems di not comply with civil defence standards.

The defendant said that he had received the amount but he said that the systems did comply with the relevant standards.

Decision

The court said that the report of the technical expert concluded that there were shortcomings in the systems which had been installed by the defendant.

The court ruled that the defendant should pay the claimant 2968469 Riyals.

The Court of Appeal – Jeddah s upheld the ruling based on the same grounds.
