This case involved an urgent request to suspend a payment order. The court should have considered if the request fell within their jurisdiction.

Background

A legal representative of a claimant filed a case against a defendant before the court. He made an urgent request to the court in order to suspend the execution of a payment order issued against the claimant. He said that the claimant was not aware of this order and did not sign it.

The court said that Article 187 of Saudi Arabia Cabinet Decision No. 11/1435y stipulated that the claimant had the right to make an objection against the decision made in the urgent issues within 10 days of the issuance of the decision.

Decision

The court ruled that the execution of the payment order should be suspended.

The defendant appealed the ruling before the court of appeal.

The court of appeal said that the court did not consider whether the consideration of the request fell under its jurisdiction or not.

The court repealed the ruling and referred the case to the relevant court.
