SCA 1293/2019
This case involved a failure to deliver purchased goods. The purchaser had provided evidence of the purchase and the defendant had failed to attend the hearing. They were ordered to pay the claimed amount and lawyer's costs.
Background
A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay him 104400 Riyals. He said that he had paid this amount to the defendant for elevators but the defendant had failed to deliver them.
Decision
The court said that the case documents revealed that the claimant had provided the court with the documents that prove his claims. The court said that the case documents also revealed that the defendant had failed to attend the court hearings though he was informed of the case.
The court ruled that the defendant should pay the claimant the mentioned amount in addition to the lawyer's expenses of 10000 Riyals.
The court of appeal upheld the ruling based on same grounds.
