This case involved an agent's claim for commission as a result of the signing of a contract. The agent failed to provide evidence or request the defendant to take the oath.

Background

A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay him an amount of money. He said that he had brokered a contracting contract for the defendant in exchange for 2.5% of the contract's value but the defendant had failed to commit to his obligations.

The defendant failed to attend the hearing.

Decision

The court said that the case documents revealed that the claimant had failed to prove his claim. The court said that the court requested the claimant to ask the defendant to take the oath but the claimant had refused to do so.

The Court of Appeal – Medina upheld the appealed ruling based on the same grounds.
