This case involved a request to appoint an arbitrator. The disputed contract involved property rental which was not classed as commercial activity so the court lacked jurisdiction.
Background
A claimant filed a case against a company before the court. He said that the two parties had agreed that the they would resort to arbitration in case of a dispute. He said that he had appointed his arbitrator but the company had ailed to do so. He requested the court to appoint an arbitrator for the company.
Decision
The court said that the case documents revealed that the contract signed between the two parties involved the rental of properties and that a dispute existed in this regard. The court said the agreed activity between the two parties was not a commercial one.
The Court of Appeal – Jeddah ruled that the consideration of the case did not fall under her jurisdiction.
