This case involved a request to validate the existence of a partnership. General evidence of a partnership between the parties was provided but it did not prove there was a specific partnership involving the named company.

Background

A claimant filed a case against a defendant before the court. He requested the court validate a partnership between the two parties. He provided the court with the evidence that proved the existence of such a partnership.

The defendant said that the two parties were not partners in the disputed company but in another company.

Decision

The court said that the case documents revealed that the evidence provided by the claimant was general and it was not specific to a certain company or a partnership. The court said that the evidence could not therefore be valid in this context.

The court dismissed the case.

The Court of Appeal – Jeddah upheld the ruling based on the same grounds.
