This case involved non-payment for equipment rental and a request to appoint an arbitrator. As the parties then reached a settlement agreement there was no need to appoint and arbitrator and the case was treated as having ended.
Background
The representative of the claimant submitted a claim to the court requesting the court appoint an individual arbitrator to settle a dispute with the defendant over a contract to rent equipment and tools as the claimant had not received the rent of 81823 Riyals. In a following hearing, the two parties attended the court and the representative of the claimant confirmed that the claimant and the defendant had agreed to limit the requested amount to 73123 Riyals and agreed to give the defendant a period of 8 months to pay. The defendant agreed and representative confirmed that the claimant agreed to drop the arbitration clause from the contracts signed between them and requested the case to be ended.
Decision
The Appeal Court Riyadh stated that the request to appoint an arbitrator had been achieved by the agreement reached by the two parties.
The court decided to end the case.
