SCA 1187/2019
This case involved non-payment for contracted work. A key issue was required evidence. There was a request to take an oath although evidence in documents was appropriate and the other party did not attend the hearing.
Background
A company filed a case against another company before the court. The company requested the court to order the other company to pay 710000 Riyals. The company stated that they had finished contracting projects for the other company but the latter had failed to commit to the obligation stipulated by the signed contract.
Decision
The court requested the first company to take the oath in order to prove their claims.
The court said that the case documents revealed that the first company had provided all the documents that proved their claims. The court said that the documents also revealed that the second company had failed to attend the court hearing.
The court ruled that the second company should pay 711435 Riyals.
The court of appeal upheld the ruling based on the same grounds.
