This case involved a claim by an individual of a partnership where the claimant was then dismissed from his role as manager. A key issue was the status of admission by one of the parties.

Background

A claimant filed a case against a defendant before the court. He requested the court to approve the existence of the partnership between the two parties and to order the defendant to pay 75000 Riyals. He said that the two parties had agreed that the claimant would be a manager of a company owned by the defendant in exchange for 5% of the profits. He said that the defendant, however, dismissed him from his position.

Decision

The court said that the case documents revealed that the defendant did not admit the partnership between the two parties. The court said that the statement made by the defendant in this regard was invalid according to Article 108 of Saudi Arabia Cabinet Decision No. 11/1435.

The court dismissed the case.

The claimant appealed the ruling before the court of appeal.

The court dismissed the appeal and upheld the appealed ruling.
