SCA 1155/2019
This case involved a request to end a partnership and who should pay what.
Background
A claimant filed a case against two defendants before the court. He requested the court to dismiss the contract signed with the defendants. He said that he had agreed with the defendants to establish a company but they had failed to commit to their obligations.
The two defendants said that they did not want to proceed in the partnership with the claimant.
Decision
The court said that the two parties wanted to end the partnership due to a lack of confidence. The court said that the defendants provided the court with all the relevant bills and that these bills were approved by the claimant.
The court ruled that the partnership contract should be dismissed. The court also ruled that the defendant should pay the claimant 455647 Riyals.
The Court of Appeal – Jeddah upheld the ruling based on the same grounds.
