The initial dispute involved a failure to pay for agreed services. A key point was one of the parties had failed to attend the hearing so a ruling could be issued in absentia.
Background
A claimant filed a case against a company before the court. He requested the court to order the company to pay him an amount of money in addition to profits. He said that he had operated an amusement park for the company and that the latter failed to commit to the obligations stipulated in the contract.
Decision
The court said that the company had failed to attend the court hearings. The court said that Article 527 of Saudi Arabia Royal Decree No. M32/1350 stipulated that if the defendant failed to attend the hearing, the claimant had the right to request the issuance of a ruling in absentia.
The court ruled that the company should pay the claimant 3073994 Riyals.
The court of appeal has upheld the ruling based on the same grounds.
