SCA 1138/2019

This case involved a refund for building work which had not been completed. It was stated the work had been suspended because the claimant did not have the relevant building license. A request was made for the claimant to take the oath.

Background

A claimant filed a case against a defendant before the court. He said that the defendant had agreed to build a building for him. He said that he had paid the defendant 370000 Riyals but the defendant had only finished 40% of the work. He requested the court to dismiss the contract and  order the defendant to pay him an amount of money.

The defendant admitted the existence of the contract but he said that he had suspended the work because the claimant had failed to get a building licence from the local council.

Decision

The court appointed an expert in order to consider the dispute between the two parties. The court said that the expert concluded that the defendant owed the claimant 416919 Riyals.

The court ruled that the defendant should pay the claimant the amount.
