SCA 1118/2019 issued on 28/07/2019

This case involved an accusation that a company which had purchased a company had been cheated as a factory had not been part of the agreement so the contract should be dismissed. The company had reviewed the company and made the purchase nine years ago.

Background

Some Claimants filed a case against defendants before the court. They requested the court to dismiss the contract they had signed with the defendants. They said that the defendants had cheated them when they sold them a factory.

The defendants said that the factory was not part of the signed deal and that the claimants were aware of this fact.

Decision

The court said that the case documents revealed that the claimants had reviewed the company that they had bought and that they had accepted the conditions of the contract and signed it. The court said that the claimants had bought the company nine years ago.

The court dismissed the case.

The court of appeal has upheld the ruling based on the same grounds.
