SCA 1116/2019
The initial dispute involved a partner's profit share. The partner refused to take an oath and the case was dismissed. A key issue was the plea for reconsideration.
Background
A claimant filed a case against a company before the court. He requested the court to order the company to pay him 1300000 Riyals in addition to the profits and the expenses of a lawyer. He said that he paid the mentioned amount as a share in the company's capital and that he did not receive the profits as stipulated in the signed contract.
The company denied the claims made by the claimant and said that the latter had received the capital and profits. The company requested the court order the claimant to take the oath. The claimant refused to take the oath.
Decision
The court dismissed the case.
The claimant made a plea to the court of appeal requesting the reconsideration of the case.
The court said that the plea did not comply with the cases stipulated by Article 200 of the Law of Advocacy.
