SCA 1115/2019

This case involved amounts due under a sales contract. A key issue was proof of the existence of the contract and lawyer's costs.

Background

A legal representative of a company filed a case against a company before the court. He said that the company supplied raw materials to the company and that they had failed to pay the value. He requested the court to order the company to pay 355275.39 Riyals and the expenses of the lawyer.

The legal representative of the second company requested the court to order the first company to prove the existence of the contractual relationship.

Decision

The court said that the case documents revealed that the second company had already approved the existence of the contract and admitted the amount they owed to the first company.

The court ruled that the second company should pay the first company the mentioned amount. The court also ruled that the company should pay the expenses of the lawyer of 35000 Riyals.

The court appealed the ruling before the court of appeal.

The court dismissed the appeal and upheld the appealed ruling.
