The initial dispute involved a failure to pay the full amount for fixing boats. The issue of staying the case was discussed as it had also been filed in another city but the other case had been dismissed.
Background
A company filed a case against a company before the court. The company requested the court to order the other company to pay an amount of money. The company said that they had fixed 14 boats for the other company and that the latter failed to pay the remaining contract amount.
The other company said that the company had filed the same case against them in another city. They requested the court to suspend the consideration of the current case until the other case was considered.
Decision
The court said that the case documents revealed that the other case had been dismissed. The court said that the appointed expert concluded that the other company owed 48090 Riyals.
The court ruled that other company should pay the company 48090 Riyals.
The Court of Appeal – Jeddah upheld the ruling based on the same grounds.
