SCA 1101/2019

This case involved a previous ruling under which the defendant was to pay a sum of money but this had not been executed by the court because they had a lack of money in their account. However, in another ruling the defendant was awarded sufficient money.

Background

A legal representative of a claimant filed a case against a defendant before the court. He said that a previous ruling had ordered the defendant to pay the claimant 44059071 Riyals. He said that the court at the time failed to execute the ruling because there was a lack of money in the defendant's account. He said that the claimant then discovered that the defendant had reached an agreement with a third party, stipulating that the defendant deserved 39565243.72 Riyals. He requested the court to impose a legal reservation on this money in accordance with Article 23 and 27 of Saudi Arabia Cabinet Decision No. 261/1433.

Decision

The court dismissed the case. The court said that the claimant was an irrelevant party in the case.

The legal representative of the claimant appealed the ruling before the court of appeal.

The court dismissed the appeal and upheld the appealed ruling.
