SCA 1059/2019
This case involved an urgent request to stop the execution of a payment order. A individual had bought a company but the previous owner had signed contracts in his name.
Background
A claimant filed a case against a defendant before the court. He said that he had bought a company from the defendant. He said that he discovered later that the defendant had signed contracts and made financial commitments on behalf of the claimant. He requested the court to dismiss the sale and to return the company to the defendant again.
The claimant said that the court had ordered him to pay 168616 Riyals and a payment order was issued against him by the court of execution. He requested the court to suspend the execution.
Decision
The court said that the request made by the claimant could not be considered urgent according to Article 205 and 206 Saudi Arabia Cabinet Decision No. 11/1435.
The court dismissed the request.
The claimant appealed the ruling before the court of appeal.
The court dismissed the appeal and upheld the appealed ruling.
