Background

The representative of the claimant filed a claim with the Commercial Court of Dammam requesting the court to revoke a contract signed between the claimant and the defendant and to request the defendant to return 103000 Riyals. The case was referred to the commercial department which issued a ruling to revoke the contract and requested the defendant to pay 110704 Riyals. The court of appeal upheld the ruling.

The representative of the defendant submitted a request to reconsider the ruling.

Decision

The court said that pursuant to Articles 200 and 201 of Saudi Arabia Cabinet Decision No. 11/1435 reconsideration requests could not be accepted against final judicial rulings except in certain cases, rules, and legal terms as provided by these two articles. The reconsideration request did not meet any of these requirements and the documents submitted by the defendant had been submitted in the previous objection and therefore the court would not consider them.
