SCA 1033/2019 issued on 13/05/2019

This case involved non-payment for purchased goods. Photographs of bills could not be used as evidence but the other company could be asked to take the oath.

Background

A company filed a case against another company before the court. The company requested the other company to pay 56850 Riyals. The company said that they had supplied the other company with goods and that latter had not paid their value.

Decision

The court said that the case documents revealed that the company had provided the court with photographs of the bills to prove their claim. The court said that the photographs could not be considered valid evidence. The court offered the company to request the other company to take the oath in order to deny the claim. The court said that the other company had failed to take the oath.

The court ruled that the other company should pay the company the mentioned amount.

The Court of Appeal – Dammam upheld the ruling based on same grounds.
