SCA 2353/2016

This case involved a contract for the sale of sheep where it was stated the number of sheep and their size breached the agreement.

Background

A claimant filed a case against two defendants before the court. He requested the court to order the defendants to pay him 731250 Riyals. He said that he had supplied the defendant with 2500 sheep but the latter failed to pay.

The defendants said that the claimant had failed to commit to the signed contract and that he supplied them with 2118 sheep only. They also said that the weight of the sheep did not comply with standards agreed between the two parties.

Decision

The court ruled that the defendants should pay the claimant $165204.

The defendants appealed the ruling before the court of appeal.

The court dismissed the appeal and upheld the appealed ruling.
