Background
A claimant filed a case against a defendant before the court. He said that he had agreed on a partnership in two projects. He said that the defendant had failed to commit to his obligations in accordance with the signed contract. He requested the court to appoint an accountant in order to review the accounting statements of the projects. The claimant also requested the court to order the defendant to pay back the capital and the profits accordingly.
The court refused to consider the case because it did not fall under the jurisdiction of the commercial court.
The claimant appealed the ruling before the court of appeal.
Decision
The court repealed the appealed ruling and said that the consideration of the case did fall under the jurisdiction of the commercial court. The case was referred to the commercial court.
