This case involved the appointment of an arbitrator where it was claimed the arbitrator was a relative of one of the parties.
Background
A company filed a case against a company before the court. It requested the court to appoint a third arbitrator. It said that the two parties had failed to chose a third arbitrator.
The court offered to appoint a person as an arbitrator and said that his expenses would be 240000 Riyals.
One company accepted the arbitrator but the other company did not. The company said that the arbitrator was a relative on one of the disputed parties.
Decision
The court said that the rejection made by the other company is invalid. The court said that the other company has noting to do with the appointment of the arbitrator.
The court appointed the mentioned arbitrator in accordance with Article 13 of Saudi Arabia Royal Decree No. M34/1433.
