SCA 3809/2015
This case involved a breach of company law where it had been considered the company's capital certificate was invalid. A key issue was the stay of the civil case because of a criminal case. As procedures for the criminal case had not started the civil case could not be stayed.
Background
Some claimants filed a case against a company before the court. They said that the company had failed to issue the agreed budgets and establish an agreed factory. They requested the court to put the company under the inspection in accordance with Article 109 of Saudi Arabia Royal Decree No. M6/1385.
The court appointed an expert in order to consider the dispute. The expert concluded that the the company’s capital certificate was invalid. The claimants requested the court to refer the previous manager of the company for investigation and to suspend the consideration of the case.
