Background

A claimant filed a case against two defendants before the court. He requested the court to order the defendants to return a tent. He said that the defendant had rented the tent for 90000 Riyals but he had failed to return it.

The court said that the consideration of the case did not fall under its jurisdiction.

The claimant appealed the ruling before the court of appeal. The court repealed the ruling and referred the case to the elementary court.

Decision

The court said that the case documents revealed that the claimant had failed to provide an evidence that proved that he rented the tent to the first defendant. The court said that the claimant also refused the oath taken by the first defendant to deny that he had received the tent.

The court dismissed the case.

The court of appeal upheld the appealed ruling.
