Sale of Goods - Undersupply - Evidence - Under payment - Discount
This case involved an underpayment for the supply of goods. Although it was claimed there had been an under supply which led to an agreed discount there was no evidence of this.
Background
A company filed a case against a company before the court. They requested the court to order the company to pay the value of some supplied goods.
The second company claimed that there had been an under supply of the supplied goods and the two parties had agreed on a discount.
Decision
The court said that the case documents revealed that the second company had failed to prove their claims about the shortage and the discount.
The court ruled that the company should pay $45175 in addition to the expenses of the lawyer of 40000 Riyals.
The court of appeal upheld the appealed ruling.
