This case accused an individual who had deliberately set fire to a car. He denied the charge but admitted unintentionally firing a rifle.
Background
The Public Prosecution filed a claim against a person accusing him of purposefully setting a car on fire which had been registered in his father’s name to prevent his father from selling it to one of his friends and requested subjecting him to a discretionary punishment.
The defendant denied the charges but admitted firing one shot from a hunting rifle unintentionally.
The Criminal Court looked at the case, the responses, and the denial of the defendant and the technical report, the lack of previous convictions, and that the private right had been waived the charges could not be confirmed. However given that he had been accused the court sentenced him to three months in prison starting from the date of detention and ordered he be subject to 50 lashes.
Decision
The court of appeal endorsed the ruling.
