This case involved a shop employee who was accused of abusing trust and taking money. The individual claimed they had lost the money and paid it back. A doubt about the abuse of trust claim led to sentencing.
Background
The Public Prosecution filed a claim against a defendant accusing him of abusing trust and taking a certain amount of money from a commercial shop in which he worked. The Prosecution requested charging him and subjecting him to a discretionary punishment.
The defendant denied the claims and abusing the trust however he admitted to losing the money because of bad management. He also said that he had already to pay the amount back to his employer.
Decision
The Criminal Court said that based on the case and the responses the defendant must be charged with losing the money and that there was a doubt of abuse of trust accusation.
The court therefore sentenced him to a year in prison starting from the date of detention.
The court of appeal endorsed the ruling.
