This case involved a request for a travel ban to be imposed on a defendant while litigation was being completed in a financial case. The court as for an estimation of the cost of insurance in this case from an expert body then put the travel ban in place.

Background

A plaintiff stated he had instituted a lawsuit against the defendant for a monetary claim which was currently being considered by the court. He requested the defendant be banned from travelling overseas until the end of the original case.

The defendant confirmed to the court the existence of this financial lawsuit against him but asked for it to be dismissed on the grounds it was a conspiracy.

Decision

According to Article 236 of the procedure laws and rules, the General Court in Hail decided to write to an expert body asking them to estimate the cost of insurance in this case. The body estimated the cost of insurance as being 5,000 Riyals. This prohibited the defendant from travelling. The plaintiff deposited a cheque of the aforementioned amount with the court president which would be included in the lawsuit file.
