This dispute involved a loan which had not been repaid. The lender swore an oath to prove he had lent the money and it was ruled the money should be returned.
Background
A man filed a case before Jeddah General Court (Case No. 32175321 Folder No.32492616 on 19/01/2013) against another who had borrowed 50,000 Riyals from him but failed to return it. The man provided the court with a witness statement and swore under oath that he had indeed lent the borrower the said amount. The court ruled that the borrower should return the money to the lender but gave the lender the right to appeal within 30 days of the date on which he receives a copy of the ruling as per the provisions of Article 176 of the Litigation Law.
Decision
The borrower appealed before the Court of Appeal but the court upheld the ruling.
