This case involved an individual who had been taking money for practising black magic. He had retracted a confession but there were witness statements confirming the accusations.

Background

The Prosecution filed a claim against a person accusing him of corrupting people’s beliefs, practicing sorcery, taking money unlawfully, and possessing talismans. The Prosecution requested charging the defendant with these offences and subjecting him to a discretionary punishment.

The defendant denied the charges and retracted his previous confession.

The criminal court said that based on the case, the responses, and following the consideration of witnesses statements which had confirmed the correctness of the case, as well as the prophetic tradition which stated “avoid the seven evils” including black magic the person would be charged.

Decision

The defendant was charged with the actions attributed to him and sentenced to three years in prison starting from the date of detention. The court also ordered his deportation. The court of appeal endorsed this.
