SCA 34271403/2013

The original dispute involved a request for payment of unpaid rent and eviction, after an individual had purchased a property with a sitting tenant but had not obtained the ownership deed. The purchaser claimed he had agreed a new rental agreement with the tenant but the tenant claimed he was not a tenant but had been given ownership of the property by a relative. The Forgery and Emulation Division was asked to verify the authenticity of the signatures on the agreement which it did. A key issue in this case was that when it was referred to the Court of Appeal they asked the Court of First Instance to clarifying the house area, dimensions, and boundaries and attempt a reconciliation between the two parties. It was then agreed that this information was not necessary to decide a case for unpaid rent and eviction, and that as the Court of First instance had made initial mediation attempts between the parties they were not required to attempt to do so again.
