Fraudulent Payment – Payment – Agency – Sponsored Employee – Employer’s liability – Oath – Payee
The original dispute involved a request which it was claimed had come from a businessman's employee (as his representative) that another man would become his partner if he paid money into a bank. The businessman claimed the request had not come from him but had been a fraud carried out by his employee who had taken the money. Under Islamic law, where a dispute rises between the payer and the recipient on the nature of the paid item, the claims believed are those of the payer if he swears under oath”.
