Ownership of land – Shares – Sale of land – Valid Case
The case involved a dispute between two sisters who had inherited land from their father and bought out their siblings' shares in the land. The dispute involved the respective shares in the land held by each sister. One sister claimed she had agreed a condition with the other her share in the land would increase if she carried out building work on an existing property on the land. The Court refused to hear the case in order for it to consider a judicial case there needed to a fruitful (or meaningful) consideration. In this case even if the consideration led to proving the woman's claims it would not be valid because a sale should not be conditioned.
