Rent to buy – Car – Accident – Sale without permission – Value of car – Compensation – Death
The case involved a dispute between a man who had been purchasing a car via a rent to buy scheme and the company which owned the car. After the car was involved in an accident the man had returned it to the company and ceased paying the instalments. He claimed the company had sold it after forging his authorization to sell it. Key points in the case were how the value of the car was calculated for compensation purposes and that compensation was not due for the death of the man's son even though the man had claimed he had been unable to look after him because of the loss of the car.
