Mortgage – Property Ownership – Loan Share – Occupant – Separate Case
The dispute involved claims of ownership of a property which was subject to a mortgage from the Real Estate Development Fund. A man claimed he had rented a villa to his brothers and there had been an agreement that the brothers would pay an equal share of the mortgage on the property. The man did not live in the property and tried to claim an increase share of the mortgage from a brother who had lived in the property for 10 years. The brother claimed the landlord did not own the property. It had merely been registered under his brother's name but their father was the real owner and one who paid the mortgage. The father had taken a separate case against this son who was the registered owner for ownership which was settled. The court dismissed the case against the brother and released him from prison.
