This case involved the purchase of a new car which frequently required repairs. The court ordered the customer should have his money refunded and the company should accept the return of the car. The sales contract was invalid.
Background
A customer filed a case before Riyadh General Court claiming that he had bought a car from a company worth 90,000 Riyals. However, he had discovered that there were faults with the car and it needed repairs from time to time. He claimed the faults were manufacturing faults and he had read in the newspapers that this model of the car had a manufacturing fault. The customer therefore requested the company to refund the cost of the car or replace it with another car. He also added he had left the car with the company for a year and they had refused to take it back.
The legal representative of the company stated that the company was ready to repair the faults regardless of their causes.
Decision
