SCAC 74/2431/2015

This case involved fake goods being transported in a van. It was claimed the goods were in transit to Kuwait but the driver and his companion were imprisoned as the van had been previously driven in Saudi Arabia.

Background

A van arrived at one of the border points holding commercial goods. The driver declared that the goods were to be delivered to Kuwait through Saudi Arabia. The goods were then transferred to another van and the GPS device was disabled. The customs department inspected the van and found that the goods were fabricated. The customs department referred the case to the Customs Initial Commission.

The commission accused the driver of the van and his companion and the owner of the van of customs evasion. The commission ruled they should pay a fine of 59297.31 Riyals and the driver and his companion should be imprisoned for six months. The commission ruled that the van and the goods should be confiscated.

Decision

The driver of the van appealed the ruling before the Customs Appeal Commission (SCAC).
