This case involved a criminal ammunition case.. A key point was happened when the defendant died.
Background
The general prosecutor filed this claim against the defendant because the investigation had led to accusing him of possession ammunition without licence. This act was criminalised by Article 40 of the Arms and Ammunitions Law, as such the General Prosecutor requested confirming the charge against the defendant and sentenced him to a prison sentence and a fine. The general prosecutor also requested the confiscation of the ammunition pursuant to the provisions of Article 50 of the Arms and Ammunitions Law.
Decision
The court said that it had received a notice by the police confirming that the defendant had died and a death certificate was presented.
The court said given that this case was under the jurisdiction of the Board of Grievances Courts, and given that there was a police letter which confirmed the death of the defendant pursuant to Article 22 of Saudi Arabia Cabinet Decision No. 12/1435 which provided that the criminal case should be dropped in some cases including the death of the defendant, this did not prevent the continuation of the private rights case.
The court said the case was dropped.
