SBG 4925/2015
This case involved whether a company should be placed in administration. The auditor's report and financial report did not show there was an urgent risk to the company and the fact it had been burgled was not relevant.
Background
A claimant filed a claim requesting the court to place a defendant company under judicial guardianship because the claimant was a partner in this company and there was an urgent danger in the company remaining under the management of the current manager. Therefore the claimant requested placing the company under a guardianship.
The defendant company said that the report by the auditor and the financial reports of the company denied what was claimed by the claimant when he stated there is a risk on the company to continue being managed by the current management. The company had been making high profits over the last few years.
