SBG 4176/2015

This case involved an individual who had tried to forge an official ID. A key issue was whether her confession could be used as evidence as she had mental health issues.

Background

The General Prosecutor said that the defendant was arrested when she was trying to obtain a replacement for an ID from the Civil Status Office. However, when the officer tried to match the photo on the ID with the photo profile saved on the computer and there was a difference in the personal photo. The defendant therefore was referred to the competent authorities. The investigation led to charging her with participating with some employees of the Civil Status (with good intention) to forge official documents. The General Prosecutor therefore requested that the defendant be punished under the provisions of Article 8 of the Anti-Forgery Criminal Law.

The defendant said that she had admitted the charge and that she had submitted an ID she found dumped on the floor. The defendant also said that she had visited a mental health hospital.
