Background
Two companies filed a case against two other companies before the court. They requested the court to dismiss an arbitration ruling issued on the dispute with the other companies. They said that the committee of arbitration had dismissed their request for the appointment of an expert.
Decision
The court considered the documents of the case. The court said that Article 49 of Saudi Arabia Royal Decree No. M34/1433 stipulated that the appeal against the arbitration ruling should not be accepted unless after filing a dismissal case against the ruling. The court said that Article 50 of Saudi Arabia Royal Decree No. M34/1433 stipulated that the dismissal case cannot be accepted unless in the cases stipulated by the mentioned article. The court said that the refusal of the appointment of an expert cannot be considered as a violation of the arbitration agreement.
The court dismissed the case.
